Confidentiality and data protection

Personal information you have provided and those obtained from other sources in connection with your studies will be held securely and used by the University of South Wales (the University) during enrolment and after you leave the University for a variety of purposes including the administration of all academic records, student support services (including those relating to health and wellbeing), careers services and the operation of the University’s Regulations and Procedures. In addition the information will be used for research and the compilation of statistics and Alumni administration. The University’s full privacy notice can be found at Annex A.

 To support your learning journey, the University would like to use the information you have submitted relating to your ethnicity as part of its Learning Analytics Programme. This information will help to enable the University to improve its teaching and support services to you and other students. Full details are available in our ‘Learning Analytics Information Booklet’.

Until 31st December 2020 - International non-EU students studying in the UK

All students who come to study at our campuses in the United Kingdom and are from outside the EU are required to:

  • hold a valid visa that allows them to study in the University, or
  • hold a Tier 4 visa, or visa under the new student immigration route due to be launched in October 2020, sponsored by the University.

From 1st January 2021 – International including EU/EEA nationals studying in the UK and arriving on or after 1st January 2021

All students who come to study at our campuses in the United Kingdom and are from outside the EU are required to:

  • hold a valid visa that allows them to study at the University
  • hold a Tier 4 visa, or visa under the new student immigration route due to be launched in October 2020, sponsored by the University
  • have applied for EU settlement scheme or have applied and received pre-settled/settled status.

From 1st January 2021 - EU/EEA nationals studying in the UK who have current/previous residency and have not yet applied for EU settlement

  • students in this category need to ensure that they have applied for EU settlement or the new student immigration route sponsored by the University by 30th June 2021
  • if a student will be completing their course at USW by 30th June 20201, and will not be applying for EU settlement, the new student route, or other appropriate immigration permission, they will need to leave the UK by 30th June 2021, or they may be categorised as an overstayer.

Students who are being sponsored under a Tier 4 student visa must also comply with the conditions and/or responsibilities imposed by their student visa and cooperate with the University of South Wales in fulfilling its Tier 4 compliance obligations. Student information is disclosed to UK Visas and Immigration (Home Office): this could be for example regarding an immigration application you have made or concerning your attendance and engagement, or requests for information, including in connection with the prevention or detection of crime, the administration of illegal working and/or the apprehension or prosecution of immigration offenders.

Non-UAE nationals studying at USW Dubai campusAll students who study in our Dubai campus should

  • hold a valid visa that allows them to study at USW Dubai.

Students who are studying at USW Dubai must also comply with the conditions and/or responsibilities of their student visa and cooperate with the University in fulfilling its UAE Immigration compliance obligations. Student information is disclosed to the UAE Immigration Authorities: this could be for instance regarding a visa application, your enrolment with USW Dubai and your attendance and engagement.

Covid-19 Pandemic: Concerns of Health and Safety and Wellbeing

Covid-19 Pandemic: Concerns of Health and Safety and WellbeingThe health and safety and wellbeing of our staff and students is paramount to USW. The ongoing impact of the Covid-19 pandemic means that USW has made and may continue to make changes to the way it delivers courses and services for the academic year 2020/2021 and those courses due to start in early 2021. Due to the pandemic and its changing nature USW may need to make such changes on short notice. 

 The methods and activities adopted by USW for the coming year may differ from those previously published or advertised. USW reserves the right to make further changes through the course of the programme of study if such change is reasonably necessary or advised due to issues of Public Health, health and safety and wellbeing, or in response to Government Guidelines. Whilst USW will use its reasonable endeavours to minimise the impact of any such changes on your overall learning experience it cannot guarantee that your programme of study or overall learning experience will not be changed.

 For the academic year 2020/2021 and courses beginning in early 2021, USW will deliver programmes of study in a blended format; with a proportion of the teaching and learning being delivered digitally, and where it is safe to do so, some teaching and learning being delivered in person, using social distancing and/or mitigating measures as deemed appropriate in line with Government Guidance.

 Information provided by USW about how its courses or services have been or may be changed or altered due to the Covid-19 pandemic is available on the USW website at: https://www.southwales.ac.uk/apply/blended-learning/ and USW will use all reasonable endeavours to inform you at the earliest opportunity about changes that may impact you. By enrolling, you are confirming that you understand and agree to the arrangements as described (see above link). 

 If as a result of material changes made in accordance with the above after you have enrolled, you no longer wish to study your course during 2020/2021, you may be able to, within the parameters specified in the University’s procedures:

  1. transfer to another course at USW or defer – this may only be available within a certain time period after your original course began, however USW will work with you to identify the options available to you in accordance with its procedures;
  2. complain in accordance with the below; or
  3. withdraw from your studies.

Complaints

USW recognises that there may be occasions where students feel they have cause for complaint about a service that they have received. USW’s Complaints Regulations and Procedure available here, apply to students during their course and for a period up to 3 months after leaving or graduating the USW. USW’s Complaints Regulations and Procedure can be accessed by students studying university courses at the University’s Partner Organisations where the complaint relates to academic matters. Where matters are the responsibility of the Partner Organisation students must access the Partner Organisation’s Complaints Procedure – in such cases, students should contact the relevant Partner Organisation’s student services for details.

Events beyond our control

USW is committed to delivering your chosen programme of study together with its other services, however, sometimes we may be prevented from doing so by events that would reasonably considered to be outside of our control, such as an act of God, fire, explosion, flood or other natural disaster, acts of terrorism, civil commotion or riot, embargos, blockades, imposition of sanctions or international or national travel restrictions, pandemic, epidemic or acts or orders of governments. Where our ability to deliver our services to you is impacted by such an event, we will do all that we reasonably can do to make such changes to our delivery of the services so that we can continue to provide the services to you, albeit in a different format or using a different delivery method. Where we are able to do this, and USW considers it reasonable, USW will have no liability for any delay in performance of the services or for any changes made so that the services can continue.

Where we are completely prevented from delivering our services to you because of such an event and we are unable to make any changes that would allow us to continue, we may cancel the programme of study and if that happens, we will consider, based on the level of service received up to the date of cancellation, whether or not you are entitled to any potential refund (whether in full or in part as appropriate).

  • I understand that if I have a student visa, my official financial sponsor may ask the University of South Wales to provide my course results and attendance to them.
  • I understand that if I have a Tier 4 visa or other student visa that allows me to study at any of the University’s campuses, I must comply with the terms of the visa and Immigration Authority requirements and I am aware of my immigration responsibilities and the record-keeping and reporting duties of the University of South Wales as specified in Annex D.
  • I understand that if necessary and appropriate following any disciplinary investigation, the University reserves the right to inform a relevant professional/external body.
  • I acknowledge that tuition fees are due for each year or stage of my course. I agree that, should the Student Loans Company or my sponsor fail to pay my fees, then I will be liable for payment of the fees in full immediately and I am aware of the University’s sanctions for non-payment.
  • I agree to abide by and observe the University’s Fees and Debt Management Policy which is specified at Annex E and I understand that if I withdraw from my course, any reduction in fees will only be made in accordance with these regulations.
  • For courses that require referral to the Disclosure and Barring Services (DBS), I understand that sufficient clearance is required for me to remain enrolled on that course.
  • I declare that, to the best of my knowledge, the information I have given in relation to my enrolment is correct. If any of the information supplied is incomplete or incorrect the University reserves the right to take any appropriate action, which may include withdrawal.
  • I understand that by accepting the Terms and Conditions I am entering into a legally binding agreement with the University of South Wales.
